Data source<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;In most cases, we will obtain your personal data directly from you. However, there may be occasions when we obtain your data from:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>an organisation funding healthcare services<\/li>\n\n\n\n<li>an insurance company or healthcare providers<\/li>\n\n\n\n<li>other healthcare providers involved in the treatment process<\/li>\n\n\n\n<li>members of your family, legal representatives or persons authorised to act on your behalf<\/li>\n\n\n\n<li>the National Health Fund (NFZ) or other authorised public bodies<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the source, the data may include identification details, contact details, details relating to employment or entitlement to benefits, billing details, and health-related data necessary for the provision of healthcare services or to fulfil legal obligations.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"5-informacje-dotyczace-profilowania\">5 Information on profiling<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We may use your personal data for profiling, which involves the automated assessment of certain personal factors relating to you. Ponadto mo\u017cemy bra\u0107 pod uwag\u0119 tak\u017ce dane statystyczne dotycz\u0105ce zachowania na stronach www, korzystania z\u00a0Portalu Pacjenta Invimed oraz preferencje wyra\u017cone w\u00a0serwisach Medi Partner;<\/li>\n\n\n\n<li>ensure <strong>top-quality services<\/strong> \u2013 including through the use of new technologies, IT, analytical or algorithmic solutions that support the organisation of services, patient care, data security and the streamlining of processes, whilst applying appropriate safeguards and respecting patients\u2019 rights. In certain situations, we will process your personal data relating to the provision of services using an algorithm to assist the staff providing your care. The algorithm does not make decisions about your treatment on its own \u2013 the decision is always made by the person providing the service. If you believe that the algorithm may have misjudged your situation, you may exercise your right to be assessed solely by a human and ask us to explain how the algorithm works.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"6-okres-przechowywania-twoich-danych-osobowych\">6 Period of retention of your personal data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We will process your data as a general rule:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>for 90 years \u2013 in connection with the maintenance and archiving of medical records relating to infertility treatment, from the time such records were first kept<\/li>\n\n\n\n<li>20 lat \u2013 w&nbsp;zwi\u0105zku z&nbsp;prowadzeniem i&nbsp;przechowywaniem dokumentacji medycznej ze \u015bwiadczonych us\u0142ug poza zakresem leczenia niep\u0142odno\u015bci;<\/li>\n\n\n\n<li>przez 6 lat \u2013 w&nbsp;zwi\u0105zku z&nbsp;dochodzeniem i&nbsp;obron\u0105 przed roszczeniami w&nbsp;zwi\u0105zku ze zrealizowanymi us\u0142ugami;<\/li>\n\n\n\n<li>for 5 years \u2013 for accounting and tax purposes;<\/li>\n\n\n\n<li>up to 2 years \u2013 in connection with the recording of calls on our helpline;<\/li>\n\n\n\n<li>up to 90 days \u2013 in connection with the CCTV monitoring carried out;<\/li>\n\n\n\n<li>until you object or withdraw your consent to the processing of your personal data, if we processed your data on such a basis.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"7-odbiorcy-twoich-danych-osobowych\">7 Recipients of your personal data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We will transfer your personal data:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>podmiotom uprawnionym przepisami prawa, w&nbsp;szczeg\u00f3lno\u015bci:\n<ul class=\"wp-block-list\">\n<li>podmiotom leczniczym w&nbsp;celu zapewnienia ci\u0105g\u0142o\u015bci leczenia oraz dost\u0119pno\u015bci opieki zdrowotnej,<\/li>\n\n\n\n<li>insurance companies,<\/li>\n\n\n\n<li>public authorities authorised to obtain your data,<\/li>\n\n\n\n<li>NFZ i MZ, w&nbsp;ramach realizowania \u015bwiadcze\u0144 ze&nbsp;\u015brodk\u00f3w publicznych;<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>entities authorised by you;<\/li>\n\n\n\n<li>podmiotom przetwarzaj\u0105cym dane w&nbsp;naszym imieniu i&nbsp;zgodnie z&nbsp;naszymi poleceniami, kt\u00f3rym zlecamy realizacj\u0119 us\u0142ug z&nbsp;zakresu m.in. Your rights in relation to the processing of personal data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You have the following rights in relation to the processing of your personal data:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>prawo do wniesienia sprzeciwu wobec przetwarzania danych w&nbsp;celach marketingowych lub badania jako\u015bci i&nbsp;satysfakcji \u2013 jako \u017ce przetwarzamy Twoje dane na podstawie prawnie uzasadnionego interesu,<\/li>\n\n\n\n<li>the right to object to the processing of your data on the grounds of a particular situation \u2013 in cases where we process your data on the basis of our legitimate interest for purposes other than those set out in point 1 above,<\/li>\n<\/ol>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li>The right of access to your personal data,<\/li>\n\n\n\n<li>The right to request the rectification of your personal data,<\/li>\n\n\n\n<li>the right to request the erasure of your personal data, provided that we are not required by law to continue processing it,<\/li>\n\n\n\n<li>The right to request the restriction of the processing of your personal data,<\/li>\n\n\n\n<li>The right to portability of your personal data.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">To exercise the above rights, please contact us or our Data Protection Officer (contact details in points 1 and 2 above).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><u>Right to lodge a complaint with an authority<\/u><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You also have the right to lodge a complaint with the supervisory authority in charge of personal data protection, i.e. the President of the Data Protection Authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><u>Right to withdraw consent to the processing of personal data<\/u><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If your data is processed on the basis of your consent, you have the right to withdraw that consent at any time without any adverse consequences. This does not affect the lawfulness of any processing carried out prior to the withdrawal of consent.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"9-przekazywanie-danych-do-panstw-trzecich\">9. Transfer of data to third countries<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In order to ensure the highest possible quality of our services, we use third-party providers, for example for IT support; as a result, personal data may be transferred outside the European Economic Area (hereinafter: EEA). We assure you that any transfer of data outside the EEA will be carried out on the basis of an appropriate agreement between us and the relevant entity, containing the standard contractual clauses adopted by the European Commission, or on the basis of a relevant decision by the European Commission. A copy of the standard contractual clauses referred to above may be obtained from the Data Protection Officer.
