Terms and conditions of the "Women's Day " competition
§ 1 General principles
- The organiser of the "Women's Day" Competition is Medi Partner Sp. z o.o, ul. Cybernetyki 19, 02-677 Warsaw, registered in the register of entrepreneurs kept by the District Court for the capital city of Warsaw, 13th Commercial Division of the National Court Register under the KRS number 0000415680, NIP 108-001-26-31, (hereinafter: "Organiser").
- The competition is run for the Invimed Clinic brand.
- The Competition is not a promotional lottery or other game of chance within the meaning of the Gambling Act of 19 November 2009. In particular, the outcome of the Competition depends on the individual efforts and competition of the participants and is not dependent on chance.
- The prizes in the Competition are provided by the Organiser. The Organiser is the pledger of the prize within the meaning of Article 921 of the Civil Code.
§ 2 Definitions
Terms used in these Regulations shall be understood to mean:
- Invimed - brand owned by the Organiser.
- Profile - Invimed brand profile on Instagram, available at: https://www.instagram.com/kliniki_invimed
- "Competition" - the "Women's Day" competition to which these Rules apply;
- "Regulations" - these rules of the "Women's Day" competition.
- "Participant" - a person who fulfils the conditions of participation set out in the Rules and has taken part in the Competition.
§ 3 Regulations
The Rules set out the terms and conditions of participation in the Competition. The Rules constitute the content of the Organiser's public promise.

§ 4 Duration and place of the competition, number of prizes
1 The Competition starts on 8.03.2025, the moment the Competition post is published on the Profile, and ends on 23.03.2025 at 23:59:59. Entries to the Competition are accepted within the aforementioned deadline.
2 The competition is organised in the territory of the Republic of Poland, through the Profile.
3. a total of six equal prizes will be awarded in the Competition - in accordance with the provisions of § 8 of the Regulations.
4 The names (profile names) of the winners of the Competition will be announced by the Organiser within 8 days of the end of the Competition, in a comment under the Competition post or as a separate post on the Profile.
§ 5 Competition Commission
In order to ensure the proper organisation and course of the Competition, and in particular to assess the correctness of the entries to the Competition, as well as to select the persons participating and choose the winners of the Competition, the Organiser will appoint a Competition Committee consisting of three persons designated by the Organiser.
(2) Members of the selection board may not participate in the Competition.
§ 6 Conditions for taking part in the competition
(1) The Competition is open to natural persons residing in the territory of the Republic of Poland who are at least eighteen years of age and have full legal capacity.
Employees, members of the Organiser's governing bodies and other persons authorised to represent the Organiser and entities directly involved in preparing and conducting the Competition, as well as persons cooperating with the above-mentioned entities on a permanent basis and members of the immediate family of the above-mentioned persons, i.e. ascendants, descendants, siblings, spouses, parents of spouses and persons in an adoptive relationship, cannot participate in the Competition.
3 Participation in the Competition and the related provision of personal data is voluntary.
4 The entries will be used for the purpose of running the Competition.
(5) Entries which the Organiser determines on the basis of reliable information to have been made from fictitious accounts shall not be considered for the Competition (disqualification) and may be deleted by the Organiser.
§ 7 Principles and course of the competition
1 To participate in the Competition, the Entrant should in turn:
1.1 Enter the Profile: https://www.instagram.com/kliniki_invimed
1.2 During the Competition period (§ 4.1 of the Rules), you have to add a comment under the Competition post, with an interesting and creative answer to the question "How do you take care of your health as a woman?". (hereinafter: "Competition Entry").
(2) The Commission will evaluate the Contest Works submitted by the deadline, taking into account in particular their conformity to the theme of the Contest, the originality and creativity of the participant, after which the six best Contest Works will be awarded.
(3) Each Entrant may submit only one Competition Work (only one post). Subsequent Contest Works submitted by the same Entrant will not be considered and may be removed by the Organiser.
The Organizer will inform about the outcome of the Contest through the Profile in the manner specified in § 4, paragraph 4, calling the winners indicated in the comment or post informing about the outcome of the Contest to contact by sending a message to the Profile.
5. the prizes will be sent to the winners by post or courier (at the Organiser's expense) to the address in Poland given to the Organiser. The condition of collecting the prize is signing a protocol of collecting the prize at the moment of collecting the prize (by courier or in the Organiser's office).
(6) In the event that, within 10 days of the announcement of the results of the Competition, it proves impossible to issue the prize to the winner, despite the Organiser and the entity involved in the delivery of the prize having exercised due diligence, in particular:
6.1. as a result of the prize not being collected by the winner despite at least two avocations and the impossibility of making further contact with the winner in order to re-dispatch the prize after it has been returned to the sender (with the proviso that the Organiser covers the costs of no more than two shipments);
6.2. as a result of the winner's failure to respond to the Organiser's request to provide the data necessary for dispatch of the prize, despite the Organiser making at least three attempts at an interval of at least three days each
- this winner forfeits the right to the prize.
7 It is not possible to pay the equivalent of the prize in money to the winner of the Competition or for the winner to transfer the right to the prize to another person.
§ 8 Prizes
The prize consists of a prize in kind to the value of 45 PLN (in words: forty-five PLN gross) which is a book entitled 'Taka twoja uroda. How endometria destroys the lives of Polish women" and a cash prize to the value of PLN 5 (in words: five zlotys).
(2) Prior to the release of the prize, the Organiser, being the payer of the due lump-sum personal income tax in the amount of 10% of the value of the prize, referred to in Article 30(1)(2) of the Personal Income Tax Act of 26 July 1991, will collect the lump-sum personal income tax from the winner of the 10% prize. The tax will be collected by deducting the tax from the value of the prize money awarded.
For the purpose of documenting the delivery of the prize and accounting for personal income tax due on the prize in the Competition, the Organiser will ask the winner to sign a record of the delivery of the prize and provide the necessary personal details for the completion of such a record (name and surname, exact address, telephone number for contact, e-mail address). Completion and signing of the protocol at the time the prize is handed over by the courier is a prerequisite for claiming the prize.
4 The prize will be handed over to the winner via courier (within 45 working days (by working days it is meant Monday to Friday, excluding public holidays) from the announcement of the Contest results. The cost of delivery of the prize shall be borne by the Organiser.
§ 9 Organiser's rights
(1) The Organiser reserves the right to exclude from the Contest (disqualification) Entrants whose actions in the Contest violate the law, good manners or the Rules, in particular Entrants who:
1.1. Enter the Competition using more than one Facebook account to enter more than one Competition Entry.
1.2. post content in the Contest that is unlawful, indecent, discriminatory on grounds of sex, race, religious opinion, nationality or ethnic origin, promotes totalitarian ideologies, contains profanity or infringes the rights of third parties.
1.3 Post Competition Entries that constitute unauthorised advertising or that constitute anti-advertising of the Organiser or any other entity in the Invimed Group.
In order to clarify any doubts regarding an Entrant's activity in the Competition, the Organiser may contact the Entrant through the means of communication indicated by the Entrant (e.g. email correspondence). During such contact, the Organiser may expect the Entrant to provide additional information relating to his/her participation in the Competition, if such information is necessary to remove any doubts arising in relation to the Entrant's activity in the Competition.
§ 10 Intellectual property rights for competition entries
Inasmuch as the Competition Work constitutes a work as defined by the Act of 4 February 1994 on copyright and neighbouring rights, by taking part in the Competition, the Entrant declares at the same time that he is the author of this Competition Work and that he is entitled to full copyrights to it, and that the Competition Work is not encumbered with the rights of third parties.
(2) The Participant, upon submission of the Competition Work, grants the Organiser a non-exclusive licence to the Competition Work submitted by the Participant in the Competition, which is a work within the meaning of the Act referred to in paragraph 1 above, for the purpose and to the extent necessary to conduct the Competition and inform about its outcome, under the terms specified in the Regulations. The licence is gratuitous, granted without territorial limitation and entitles the holder to grant further sub-licences.
§ 11 Personal data

3.Categories of data subjects and scope of data processed
(a) The controller shall process the data of persons who:
Have entered the Competition in the manner indicated in the Rules,
They added the comment on Invimed's official profile on the social network Instagram https://www.instagram.com/kliniki_invimed
Have become winners of the competition (Winners)
(b) The controller processes the following types of personal data:
Instagram identifier (usually including your name or nickname);
profile photo;
information you provide about yourself to the Administrator (e.g. through the content of comments you have added or photos you have published on our fanpage in connection with your participation in the Competition);
4 Aims and basis of processing
The controller processes your personal data:
And on the basis of the agreement entered into, which is the acceptance of the Terms and Conditions (Art. 6(1)(b) RODO in order to conduct the "How do you take care of your health as a woman?" competition and to implement its provisions.
II on the basis of a legitimate interest (Article 6(1)(f) RODO) consisting in:
a) as set out in the Competition Terms and Conditions, to promote events and the brand, products and services, to build and maintain a community with the Administrator and to communicate through the available functionalities of the Instagram website (comments, messages);
(b) the possible establishment, assertion or defence of claims;
II) on the basis of statutory requirements in order for the Administrator to fulfil its legal obligations under the law, in particular in connection with Article 74(2) of the Accounting Act (basis under Article 6(1)(c) of the DPA).
5 Data recipients
Access to your data will be available to:
a) subcontractors (in particular the Competition Organiser), entities that process data on our behalf and in accordance with our instructions - these are entities to which we outsource the provision of various services in the field of, inter alia, IT and marketing; entities that provide us with services
from legal services (where this proves necessary for the establishment, investigation or defence of claims), authorised employees of the Administrator;
b) other Users of the Instagram portal (due to the fact that information about the fanpage's followers, likes, as well as the content of comments, posts and other information provided by Users is public);
(c) public authorities and entities performing public tasks or acting on behalf of public authorities, to the extent and for the purposes arising from generally applicable law;
(d) the owner of the social network Instagram under the terms available online.
6. Transfers of data to third countries or international organisations
In order to ensure the highest possible quality of our services, we use suppliers, e.g. for IT support. Accordingly, your personal data may be transferred outside the European Union. We assure you that, in such a case, the transfer of data will be based on an appropriate agreement between us and such a provider, containing standard data protection clauses adopted by the European Commission, or on the basis of a relevant decision of the European Commission.
7 Data retention period
The duration of data processing is related to the purposes and grounds for processing, therefore:
(a) data processed on the basis of statutory requirements will be processed for a period of time,
where data retention is mandated by law (for 5 years - for accounting purposes and for tax reasons, the period is calculated from the end of the calendar year in which the tax liability arose);
b) data processed on the basis of the legitimate interest of the Administrator shall be processed until an objection is lodged effectively or the interest ceases, e.g. data processed in order to assert or defend against claims shall be processed for a period equal to the period of limitation of these claims (for 6 years - in connection with the assertion of the
and defence against claims in connection with the services provided);
8 Rights of data subjects
You have the right:
request access to your personal data, their rectification, erasure
or restriction of processing, as well as the right to data portability, c) to object at any time to the processing of your data;
(d) to object to the processing of your data, based on your particular situation; (e) to lodge a complaint with the President of the Office for Personal Data Protection, 2 Stawki Street; 00-193 Warsaw;
9 Other information
(a) Personal data will not be subject to automated decision-making, including profiling.
b) The provision of your data is voluntary but necessary in order to participate
in the competition.
Medi Partner Sp. z o.o. points out that, together with Instagram, they act as joint controllers with regard to data processing for statistics.

§ 12 Final provisions
All complaints related to the Programme should be reported exclusively to the Invimed Marketing Department (marketing@invimed.pl). By joining the Programme, the Participant accepts the content of these Regulations and agrees to comply with their provisions. These Regulations are available for inspection in the registered office of Invimed and on the website dedicated to the Programme.
