Procedure for the exercise of rights

Exercise of rights concerning your personal data processed by Medi Partner Ltd.

As we hold your data, you have rights in relation to its processing under the General Data Protection Regulation (GDPR). Below you will find all the necessary information on how to claim and exercise your rights.

1. How can I make a request to exercise my rights in relation to the processing of personal data?

You can do this in several ways:

  • via the contact form in the Contact section

  • by telephone by calling the Hotline: 500 900 888

  • in person at each branch

  • by sending a message directly to the Data Protection Officer of our company - Barbara Murdza- at the following address: iod@medipartner.pl

2. what can I ask for?

You have the following rights in relation to the processing of your personal data:

  • The right to object to the processing of data for marketing purposes,

  • The right to object to the processing of your data on the grounds of your particular situation; in cases where we process your data on the basis of our legitimate interest,

  • the right to withdraw consent,

  • The right of access to your personal data,

  • The right to request the rectification of your personal data,

  • The right to request the deletion of your personal data (only if we are not obliged by law to process it),

  • The right to request the restriction of the processing of your personal data,

  • The right to portability of your personal data, i.e. the right to receive your personal data from us, in a structured, commonly used, machine-readable IT format; you may send this data to another controller or request that we send your data to another controller, however, we will only do so if such a transfer is technically possible.

3 What information should I include in my application?

In order to be able to accept your application and be able to analyse it and prepare a response to it, we need to know:

  • who you are,

  • which right and to what extent you wish to exercise it,

  • what is the preferred feedback channel.

4 How long will I have to wait for the request to be answered and fulfilled?

In order to carefully review your case and, where appropriate, to be able to fulfil your request, we have adopted the following lead times for the following requests:

  • 21 days - the right to object to processing for marketing purposes,

  • 21 days - right to object to the processing on grounds of particular situation

  • 30 days - right of access

  • 7 days - right to request rectification of data

  • 21 days - right to request restriction of data processing

  • 7 days - right to request erasure of data ('right to be forgotten')

  • 21 days - right to data portability

5. Will I incur any costs in exercising my rights?

The exercise of data subjects' rights is free of charge. However, in the case of the right of access, we reserve the right, in accordance with the law, to charge a fee for subsequent copies of the data resulting from the exercise of the right under Article 15 RODO.

Will every request I make be met?

Any request made will be forwarded to our Data Protection Officer for analysis. This will result in a response regarding its implementation, which you will receive from us.

At the same time, we would like to inform you that the result of the analysis may be the refusal of the request made in the event that it proves to be unfounded, in accordance with the applicable legal provisions.

EXAMPLE

An example of an unreasonable request may be the inability to exercise the right to erasure of data ( ''to be forgotten'') in the case of medical records produced at Medi Partner Sp. z o.o., when, as a healthcare provider, we are obliged by law to process the data contained in the medical records, as a rule, for a period of 20 years (Patient Rights and Patient Ombudsman Act).
